ARCHITECTURAL CONTROL COMMITTEE SWEETWATER RIDGE


According to Sweetwater Ridge documents titled SCTPOA CC&Rs an Architectural Control Committee (ACC) shall be composed of four (4) or more persons chosen by the board of trustees. The Committee shall adopt policies and procedures, subject to approval by the board of trustees, for its operation.

No structures, buildings, deck, shed, fence or other permanent improvements shall be constructed, built, placed or erected on the property, or any portion thereof, without the prior written consent of the committee.  Homeowners will be fined $500 if they build without first obtaining a building permit.   In addition, no digging or placing of mobile homes will be allowed between 1 November and 1 April each year.

Any owner desiring to construct, build, place or erect a structure or desiring to alter, amend or add to an existing structure or make other improvements, shall submit a written application with complete plans and specification for the proposed project for approval of the committee. A $25 fee will be charged to process the permit.

Fences are recommended for retaining walls or safety only.

In deciding whether to approve or disapprove plans and specifications submitted to the committee, the committee will use its best judgment to ensure all improvements, construction and landscaping conform to and harmonize with existing surroundings and structures and are consistent with the uses of the property while considering the neighbors as well.

All regulations required by Rich County, the State of Utah and Sweetwater Ridge must be followed. Any variance to Sweetwater Ridge policies must be approved by the board of trustees. The ACC committee does not have the authority to approve any variance to building codes, nor does the Rich County Building inspector. Any Variance request to building codes, must be approved by the Rich County Commissioners.

Sweetwater Ridge setbacks for buildings are: 8 feet one side, 10 feet on the other side subject to neighboring units. Front set back is 10 feet from the property approximately 30 feet from the center of the road. Rear setback is 9 feet. If common areas are adjacent to the property, setbacks can be approved as follows: 1 foot from the back, 5 feet from the side. All measurements are from the edge of the building, deck, or steps. Eighteen (18) feet is required between neighboring units in all cases. A survey by a licensed Surveyor is recommended before any construction is undertaken to avoid property disputes between owners, building inspectors, and Rich County.

Seasonal or mobile units do not require building inspections but do need to follow setback requirements. Permanent structures require building permits and inspections for setbacks, water, sewer and power hook ups.

The committee and the board of trustees shall not be held liable for damages by reason of any action, inaction, approval, or disapproval by it with respect to any request made pursuant to Article 5 of the Bylaws. The Association through its officers, the board of trustees, the Architectural Control Committee or other appropriate persons or committees, shall have the authority to promulgate and enforce such reasonable rules, regulations, and procedures as many be necessary or desirable to aid the Association in carrying out any of its functions or to ensure that the property is maintained and used in a manner consistent with the interests of the owners.  A fine of $500 will be assessed for infractions to the SCTPOA guidelines.

Structures existing prior to December 5 1986 that are in good repair are considered under the” Grand Father Clause”.

These controls are provided for in Article 6, 7 and 9 of the SCTPOA Bylaws, and in the agreements reached with Rich County Commissioner Blair Francis and Allan Harrison of the Bear Lake Regional Commission.

 

 PROCESSING AN ARCHITECTURAL CONTROL FROM

  1. The person applying for a building permit will complete the Architectural Control Request Form and attach drawings/plans to the form for processing. The form and all information will be sent to the ACC Committee Chairman who will take action to process the request. When an ACC committee member is a relative to the requester, the request must be handled by another committee member to avoid favoritism.
  2. Verify to insure the person of persons submitting the request for a building permit is a lot owner. If the person/persons do not have ownership or title to a lot, the request should be returned to the originator until ownership or title can be provided.
  3. Review the request form to see if it contains all the information required. (Refer to the Architectural Control Requirements Sheet)
  4. Mobile Home: Go to the lot and verify property lines to insure the mobile home will fit on the lot as specified in the attached sketch and it meets the setback requirements.
  5. Verify to ensure that the mobile home is not older the 20 years old. If the mobile home is older than 20 years the request form must go to the Board of Trustees for approval/disapproval and a waiver.
  6. Storage Shed: Check to make sure the storage shed meets all requirements. (A storage shed 10 X 12 feet or 120 square feet or less does require a Sweetwater Ridge permit, but DOES NOT require a Rich county permit.
  7. Roof over trailer/mobile home: check the height of the roof to make sure it does not exceed the height limit of sixteen (16) feet. Check to make sure it meets the setback requirements.
  8. No fences are permitted except for safety along high retaining walls and are not to exceed 36 inches in height. Approval must be obtained by submitting a building permit request to the ACC committee.
  9. Set back requirements for lots next to a common area will be eight (8) feet but can have a variance depending on the common area usage.
  10. We discourage the planting of lawns but if you feel like you have to plant grass, it can be NO MORE THAN 12 X 12 or 144 square feet. This is a water issue nothing else!
  11. Repairs: A building permit will be required if repairs are 50% of the original. A building permit will not be required when minor repairs are made to existing home/trailers, skirting, sheds, porches/decks or awnings.
  12. If the ACC committee does not approve a project, the member may request a variance and the board of trustees will review the request and approve/disapprove the variance.
  13. The request for a building permit will usually be processed within thirty (30) days. If the request needs approval/disapproval from the board it could take longer.
